Truckers Working Long Hours? But Don’t Get Paid Overtime?

If you are based in WA, you qualify for overtime. Period.

Under the Federal Motor Carrier Act, many drivers miss out.

But under Washington’s wage laws, the exemption doesn’t apply. In fact, the  Washington Supreme Court also ruled Washington-based truck drivers should be paid overtime on all hours worked, including hours spent driving out of state. (Bostain v. Food Express, Inc., 159 Wn.2d 700, 153 P.3d 846 (2007)). 


That’s right: you should count ALL the hours your worked for overtime pay both inside and outside of Washington.

“I’ll get fired if I say anything.”
 → Wrong. Retaliation is illegal. I've never seen a driver fired for speaking up.

“I signed a contract — doesn’t that block me?”
→ No contract can erase your legal right to overtime.

“They said I’m an independent contractor.”
→ If they control your schedule, routes, or pay method — you might still count as an employee.

“It’s not worth my time.”
→ You can recover 3 years of back pay and potentially even double that. And if you win, the company has to pay your attorney’s fees.
